1. Acceptance of Terms & Legal Binding

By accessing or using the services provided by imrHosting ("we," "us," or "our"), you agree to be bound by these Terms of Service (the "Agreement"). This agreement constitutes a legally binding digital contract recognized under the Information Technology Act, 2000 and the Indian Contract Act, 1872. These terms apply universally to all current, past, and future clients. If you do not agree to these terms, you must immediately cease using our services.

2. Account Eligibility

You must be at least 18 years of age to register for an account. By registering, you represent and warrant that the information you provide is accurate, current, and complete.

3. Acceptable Use Policy

You agree not to use our services for any unlawful purpose or in any way that interrupts, damages, or impairs our services. Prohibited activities include, but are not limited to:

  • Hosting or distributing malware, viruses, or phishing content.
  • Sending unsolicited bulk email (SPAM).
  • Hosting illegal content, including copyrighted material without permission.
  • Running CPU-intensive scripts or cryptocurrency miners.
  • Attempting to gain unauthorized access to our servers or other user accounts.

4. Payments and Billing

  • Fees: You agree to pay all fees associated with your chosen plan in advance.
  • Renewals: Services will automatically renew unless canceled prior to the renewal date.
  • Late Payments: Accounts with overdue invoices may be suspended after 3 days and terminated after 14 days.
  • Refunds: Refunds are governed by our Refund Policy.

5. Backups and Data Loss

While we perform daily backups for disaster recovery purposes, you are solely responsible for maintaining your own backups of your website files and databases. imrHosting accepts no liability for data loss under any circumstances.

6. Termination and Unforeseen Downtime

Termination Without Notice: imrHosting reserves the absolute right to suspend, terminate, or cancel any hosting service at any time, with or without prior notice, at our sole discretion. This includes situations involving upstream provider bans, datacenter failures, or business constraints.

Sudden Server Termination & Migration: In the event of a sudden upstream server termination, hardware crash, or ban, no legal action can be taken against imrHosting for any resulting downtime or data loss. While we may offer courtesy assistance to migrate your account to a new server, we do not provide any guarantee regarding the timeframe. If our migration process is delayed, you are solely responsible for independently migrating your data using your own offline backups.

7. Non-Refundable Policy & Chargeback Waiver

No Refunds on Upstream Failures: All hosting payments are strictly for the infrastructure provisioning and are non-refundable once the server is provisioned and handed over to the client. In the event of sudden service suspension, ban, or hardware failure at our upstream provider before the completion of your billing cycle, imrHosting is not liable for any service continuation or refunds.

Chargeback Waiver: By agreeing to these terms, the client explicitly waives the right to initiate a chargeback or payment dispute through their bank or payment gateway for any downtime, data loss, or sudden upstream server termination. Any payment gateway disputes filed contrary to this policy will be contested using this digital agreement and may result in a permanent ban from our services.

8. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, specifically governed by the Indian Contract Act, 1872 and the Information Technology Act, 2000, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

9. Changes to Terms & Universal Applicability

We reserve the right to modify these terms at any time. The updated terms apply automatically and retroactively to all active accounts, services, and clients. We will notify you of significant changes via email or a notice on our dashboard. Continued use of our services constitutes full acceptance of the new terms.
